Clanomega Solutions Private Limited – Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs the use of the SMARCK platform, websites, and related services (collectively, the “Services”). SMARCK is a hybrid cloud-based data archiving and management platform owned and operated by Clanomega Solutions Private Limited (“Clanomega”, “Company”, “we”, “us”, or “our”).

This AUP forms part of the SMARCK Terms & Conditions. By accessing or using the Services, you agree to comply with this AUP. If you do not agree, you must not use the Services.

1. Purpose of This Policy

The purpose of this AUP is to ensure that SMARCK is used in a lawful, secure, ethical,and responsible manner. This policy is designed to protect the integrity, availability,security, and reliability of the SMARCK platform, its users, and Clanomega.

2. Prohibited Activities

You must not use the Services to engage in any activity that:

• Violates any applicable law, regulation, or legal obligation at the local, national, or international level
• Infringes or misappropriates the intellectual property, proprietary, or privacy rights of Clanomega or any third party
• Compromises platform security, including unauthorized access, probing, scanning, penetration testing, hacking, phishing, or credential harvesting
• Introduces or distributes malicious software, including viruses, worms, trojans, ransomware, spyware, or similar harmful code
• Transmits unsolicited or unauthorized communications, including spam, bulk messaging, phishing attempts, or deceptive communications
• Harasses, abuses, threatens, defames, discriminates against, or incites violence against any individual or group
• Exploits vulnerabilities or attempts to interfere with, disrupt, or degrade the performance, availability, or integrity of the Services or associated systems
• Misrepresents identity, impersonates any individual or entity, or falsely claims affiliation with any person or organization
• Uses the Services for purposes other than their intended business and operational use, including resale, sublicensing, or unauthorized commercial exploitation

3. User Responsibilities

You are responsible for:

• Ensuring that your use of the Services complies with this AUP, the SMARCK Terms & Conditions, and all applicable laws and regulations
• Maintaining the confidentiality and security of your account credentials
• Preventing unauthorized access to or use of your account
• Promptly notifying Clanomega of any suspected violation of this AUP, security incident, or unauthorized use of the Services

4. Monitoring and Enforcement

Clanomega reserves the right, but does not assume the obligation, to:

• Monitor use of the Services for compliance with this AUP
• Investigate suspected violations
• Suspend or terminate access to the Services, in whole or in part, with or without notice, where we reasonably believe a violation has occurred
• Remove or restrict access to content or activities that violate this AUP or applicable law
• Cooperate with law enforcement, regulators, or other authorities where required by law or where we deem such cooperation reasonably necessary

5. Consequences of Violations

Violations of this AUP may result in one or more of the following actions, at Clanomega’s sole discretion:

• Temporary suspension of access to the Services
• Permanent termination of accounts or subscriptions
• Legal action, including civil or criminal proceedings where appropriate
• Disclosure of relevant information to law enforcement or regulatory authorities, as required by applicable law

6. Changes to This Policy

Clanomega may modify this AUP from time to time. Any updates will be effective upon posting on the SMARCK website or within the Services. Continued use of the Services following such updates constitutes acceptance of the revised AUP. Any legal disputes arising from this privacy policy are subjected jurisdiction of Courts Hyderabad, India.
